            It is not a certified laboratory measurement, not a medical device, and must not be used as the sole basis
            for decisions about drinking water safety, health, or regulatory compliance. Always confirm water quality with

1. About QualiWater

QualiWater is a mobile application and related services provided by SpectoLab Inc., established in Turkiye, with its registered office at ŞİŞLİ İSTANBUL (referred to as "we", "us", or "our").

QualiWater provides approximate color estimations of water samples on the APHA / PtCo (Hazen) color scale, based on images captured with a compatible device. The service is intended only for informational and educational purposes. It is not a certified laboratory device or measurement system and is not intended to be used as a basis for official, regulatory, health, or safety decisions.

2. Acceptance of these terms

By installing, accessing, or using QualiWater, you confirm that you have read, understood, and agree to be bound by these Terms of Use and this Privacy Notice. If you do not agree, you must not use the app or related services.

If you use the app on behalf of a company or other legal entity, you represent that you are authorized to bind that entity and that the entity accepts these terms.

3. Eligibility and user capacity

The app is intended for individuals who have legal capacity to enter into a contract under the laws of their country of residence. If you do not have such capacity, you may only use the app under the supervision and with the consent of a parent or legal guardian. By using the app, you confirm that you meet these conditions.

4. Service description and key limitations

QualiWater uses image processing and artificial intelligence models to estimate apparent color metrics such as APHA / PtCo values from photographs of water samples. The output is always an approximation and may be affected by many factors, including lighting conditions, camera characteristics, sample containers, sample handling, background, and inherent model limitations.

The results:

are not certified laboratory measurements,
do not replace accredited laboratory tests or official monitoring procedures,
must not be used as the sole basis for drinking water safety decisions, industrial process control, environmental compliance, medical or health related decisions, or any other safety critical context.

You remain fully responsible for verifying water quality with appropriate certified laboratories or authorities and for complying with all applicable regulations.

5. No medical, health, or regulatory advice

QualiWater does not provide medical advice, health advice, or regulatory compliance advice. Any information generated by the app is general information and does not take into account your specific situation. You must not rely on the app as a substitute for professional laboratory analysis or expert advice from qualified professionals or regulatory bodies.

6. User responsibilities

You agree to:

use the app only for lawful purposes and in compliance with all laws and regulations applicable in your jurisdiction, including EU and Turkish law where relevant,
ensure that any water related decisions are based on appropriate certified measurements and professional judgment,
not attempt to misuse, reverse engineer, or interfere with the app or its infrastructure,
not upload any illegal content or content that violates the rights of others.

7. Intellectual property

All rights in and to QualiWater, including the software, algorithms, trademarks, logos, text, graphics, and other content, are owned by SpectoLab Inc. or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non exclusive, non transferable, revocable license to use the app solely for your internal purposes and in accordance with these terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the app except where this is expressly permitted by mandatory law.

8. User content

When you capture and upload images or other content to the app ("User Content"), you remain the owner of your content. You grant SpectoLab Inc. a non exclusive, worldwide, royalty free license to use, store, process, and analyze your User Content for the following purposes:

to provide and improve the app and its features,
to maintain security and prevent misuse,
to develop and validate algorithms and models, where feasible using anonymized or aggregated data.

You must ensure that you have all necessary rights to provide such User Content and that it does not infringe the rights of any third party.

9. Prohibited uses

You agree not to use QualiWater to:

perform or support unlawful activities,
avoid or circumvent required laboratory testing or official controls,
process or store personal health data or other sensitive personal data in a way that links water measurements to an identified or identifiable individual,
harass, abuse, or harm others.

10. Disclaimers

QualiWater is provided "as is" and "as available". To the maximum extent permitted by applicable law, we do not give any warranties or representations regarding the accuracy, reliability, completeness, or suitability of the app or its results for any particular purpose.

We do not guarantee that the app will be uninterrupted, secure, or error free, or that any defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by applicable law, SpectoLab Inc. and its directors, employees, and partners are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or in connection with the use of or inability to use QualiWater.

Where liability cannot be excluded under mandatory law, our total aggregate liability related to the app is limited to the amount you have paid for the use of the app in the twelve months preceding the event giving rise to the claim, or, if no payment was made, to a reasonable amount not exceeding 10 EUR, unless applicable law requires a higher limit.

12. Compliance with EU and Turkish law

We aim to comply with applicable data protection and consumer protection laws, including the EU General Data Protection Regulation (GDPR) and the Turkish Law on the Protection of Personal Data No 6698 (KVKK), to the extent they apply to our activities. Your specific rights and our obligations may depend on your place of residence, the location of our operations, and the nature of the processing.

13.2 Infrastructure and hosting

Our application backend, databases, and related services are hosted on cloud infrastructure provided by one or more external service providers. These providers act as our data processors and process personal data only on our documented instructions and for the purposes described in this Privacy Notice.

We select hosting regions that are appropriate for our users and our legal obligations. As a general rule, personal data is stored in data centers located within the European Union or the European Economic Area in order to support compliance with EU data protection rules. We may change our infrastructure providers or hosting arrangements from time to time, but we will not do so in a way that materially reduces the level of protection for your personal data compared with the level described here.

13.3 Categories of data we process

Depending on how you use the app, we may process the following categories of data:

Account data, such as name, email address, and account identifiers, if you create an account or contact us.
Usage data, such as app usage logs, device identifiers, crash logs, and basic analytics data.
Image data, namely the images you capture of water samples and related technical metadata (for example device model and timestamp).
Payment related data, if you purchase paid features, processed through third party payment providers.

We do not intend to process special categories of personal data such as health data. You should not use the app in a way that links water test results to identified individuals or health conditions.

13.4 Purposes and legal bases

We process your personal data for the following purposes and legal bases under GDPR and KVKK:

To provide the app and its functions to you, including processing images and showing results. Legal basis: performance of a contract or steps prior to entering into a contract, and our legitimate interests in operating the app.
To maintain and improve the app, including analytics, debugging, and model improvement using aggregated or anonymized data. Legal basis: our legitimate interests in improving our services.
To handle your support requests and communications. Legal basis: performance of a contract and our legitimate interests in responding to users.
To comply with legal obligations, for example accounting or regulatory obligations. Legal basis: compliance with legal obligations.
Where required by law for certain analytics or marketing cookies or features, we rely on your consent, which you can withdraw at any time.

13.5 Data sharing, hosting, and transfers

We may share your personal data with carefully selected third parties that provide infrastructure, hosting, storage, logging, analytics, email delivery, or customer support services. These third parties act as our data processors under written agreements and are required to protect your personal data and to process it only according to our instructions.

As noted above, our primary hosting locations for application data are in data centers within the European Union or the European Economic Area. However, some of our service providers or their sub processors may be located in other countries. If personal data is transferred to countries outside the European Economic Area or Turkey, we will implement appropriate safeguards as required by applicable law, such as standard contractual clauses or equivalent mechanisms, and we will provide information about these safeguards on request.

We may also share your personal data with:

payment service providers that process your payments under their own terms and privacy notices,
professional advisers, such as lawyers and accountants, where necessary for the protection of our rights and compliance with our obligations,
public authorities, courts, or regulators where we are legally required to do so.

13.6 Data retention

We retain personal data only as long as necessary for the purposes described above or as required by law. After the relevant retention period, data will be deleted or irreversibly anonymized.

13.7 Your rights

Subject to the conditions and limitations set by GDPR and KVKK, you may have the following rights regarding your personal data:

Right of access to your data,
Right to rectification of inaccurate or incomplete data,
Right to erasure where legal conditions are met,
Right to restriction of processing in certain circumstances,
Right to object to processing based on legitimate interests,
Right to data portability where applicable,
Right to withdraw consent where processing is based on consent, without affecting the lawfulness of processing before withdrawal.

To exercise your rights, please contact us at qwsupport@spectolab.com. You may also have the right to lodge a complaint with a supervisory authority, such as your local data protection authority, the relevant EU data protection authority, or the Turkish Personal Data Protection Authority (KVKK).

13.8 Children

QualiWater is not specifically designed for children and we do not knowingly collect personal data from children without appropriate consent where this is required by law. If you are under the age at which you can provide valid consent to data processing or enter into a contract in your country, you should use the app only with the involvement and consent of a parent or legal guardian. If you believe that a child has provided personal data to us without the necessary consent, please contact us so that we can take appropriate steps.

14. Changes to these terms and this privacy notice

We may update these Terms of Use and this Privacy Notice from time to time, for example to reflect legal or technical changes or changes to our service providers. The latest version will be available in the app and on our website, with the date of the latest update. If changes are significant, we will take appropriate steps to inform you, for example through an in app notice.
